Terms and Conditions
1. General
1.1. Welcome to the website TopMarket.co.il (the “Website”), operated by TopMarket.co.il (the “Company”). The Website offers a wide range of products and services from leading manufacturers and distributors.
1.2. Any use of the Website, including placing orders or purchasing products, constitutes full and unconditional acceptance of these Terms and Conditions (the “Terms”).
1.3. These Terms apply equally to all genders; masculine language is used for convenience only.
1.4. In the event of any error in the price and/or technical specifications of a product displayed on the Website, and only where such error is clear and obvious, the binding price shall be the price recorded in the Company’s offices. The Company shall correct any such error promptly upon discovery and notify customers accordingly.
2. Warranty
2.1. Subject to the provisions herein, the Company shall, at its sole discretion, repair or replace, free of charge, any product purchased via authorized distributors of the Company, where a defect is found under normal and proper use and in accordance with the manufacturer’s instructions.
2.2. The warranty applies solely to the original purchaser who purchased the product directly from the Company or from an authorized distributor listed on the Website. The purchaser may transfer the warranty to a third party, provided that the Company is notified in writing prior to such transfer.
2.3. The warranty shall not apply in any of the following cases:
- Improper use or operation not in accordance with instructions;
- Damage caused by negligence, misuse, accident, electrical faults, unsuitable infrastructure, lightning, force majeure, or use of non-approved consumables;
- Any repair, modification, or tampering performed by unauthorized personnel;
- Alteration, removal, or defacement of product identification or serial numbers;
- Damage caused by battery leakage;
- Damage resulting from the use of non-approved components or equipment;
- Consumable items (including but not limited to ink cartridges, toners, disks, and software);
- Any direct or indirect damage, including damage to third parties;
- Use of the product with improper electrical voltage or contrary to manufacturer or utility provider instructions.
2.4. Repairs shall be carried out during standard business hours, Sunday through Thursday, 09:00–17:00, excluding public holidays.
2.5. Products, services, and information on the Website may include inaccuracies or typographical errors, including discrepancies in product color representation. In cases of clear and obvious errors, the Company reserves the right to cancel the transaction without charging cancellation fees.
2.6. All products and services are provided on an “AS-IS” basis, without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
2.7. Under no circumstances shall the Company be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, data, or use, except where such liability cannot be excluded under applicable law.
2.8. Where the manufacturer or importer cannot be located and the product price exceeds 400 NIS, warranty responsibility shall fall upon the Company.
2.9. Warranty for branded products (including but not limited to Dell, Asus, Lenovo, D-Link, Mag, MicroLab) shall be provided by the manufacturer or importer unless expressly stated otherwise. The Company acts solely as an intermediary.
3. Privacy
3.1. Personal information provided by users, including purchase details, shall be stored in the Company’s database and shall not be transferred to third parties, except as required to complete the transaction or as required by law.
3.2. The provision of personal data is voluntary; however, failure to provide such data may prevent the completion of orders.
3.3. Marketing communications shall be sent only upon the user’s explicit consent (opt-in).
3.4. The Company implements reasonable security measures to protect user data; however, it does not guarantee absolute security and shall not be liable for unauthorized access beyond its control.
4. Cancellation of Transactions and Returns
4.1. Transactions may be canceled in accordance with the Israeli Consumer Protection Law, 1981.
4.2. Cancellation not due to defect or non-conformity shall incur a cancellation fee equal to the lesser of 5% of the transaction value or 100 NIS.
4.3. Cancellation is permitted within 14 days from receipt of the product or disclosure document, whichever is later.
4.4. Products must be returned, where reasonably possible, in their original packaging and condition.
4.5. Return shipping costs shall be borne by the customer unless the cancellation is due to defect or non-conformity.
4.6. The Company reserves the right to claim compensation for any reduction in product value.
4.7. Consumable products (e.g., ink cartridges, toners) are non-returnable.
4.8. Products that can be copied or reproduced (e.g., software, media) may not be returned once opened, unless defective.
4.9. Where a defect is established, the Company shall bear all associated costs.
4.10. For digital products (including software licenses delivered electronically), cancellation shall not be permitted once the license key has been delivered.
5. Payments
5.1. Payments may be made using accepted credit cards.
5.2. Installment payments are available, subject to a minimum amount per installment.
5.3. Transactions using American Express or Diners cards exceeding six installments may incur an additional processing fee.
6. Shipping and Delivery
6.1. Orders are typically dispatched within 48 hours following payment authorization, subject to product availability.
6.2. Delivery shall be completed within up to 14 business days unless otherwise specified.
6.3. The Company shall notify customers of any delays and shall allow cancellation without fees in cases of significant delay.
6.4. Changes to delivery address after dispatch may incur additional charges.
6.5. In the event that a product becomes unavailable, the customer shall be offered a substitute or the option to cancel the transaction without charge.
7. Non-Delivery Claims
7.1. The customer must notify the Company of non-delivery within one business day following the expected delivery date.
7.2. Failure to provide such notice shall be deemed confirmation of receipt.
8. Self-Collection
Customers may collect products from the Company’s premises upon prior coordination and confirmation.
9. Use of Website Content
9.1. All content on the Website is provided for personal use only.
9.2. Users shall not copy, reproduce, distribute, publish, or otherwise use Website content without prior written consent.
9.3. Commercial use of Website content is strictly prohibited.
9.4. Users shall not collect email addresses or other data for commercial purposes.
10. Intellectual Property
10.1. All intellectual property rights in the Website and its content are owned by the Company or licensed third parties.
10.2. No rights are granted to users other than personal, non-commercial use.
11. Governing Law and Jurisdiction
11.1. These Terms shall be governed exclusively by the laws of the State of Israel.
11.2. Exclusive jurisdiction shall lie with the competent courts in Rehovot, Tel Aviv, Haifa, and Be’er Sheva.
